Charitable organization «Charitable Foundation «Peremoga Ukraine»

1. General provisions

1.1. Charitable organization «Charitable Foundation «Peremoga Ukraine» (hereinafter «Foundation», «We» in any case), which is the Owner and Manager of personal data, in the sense of the Law of Ukraine «On the Protection of Personal Data», carries out charitable activities in accordance with the Law of Ukraine «About charitable activities and charitable organizations» by providing charitable assistance in the areas of activity defined in the Foundation's Charter and in accordance with the Charity program and Charity projects implemented by the Foundation, at the expense of funds and property received from legal entities and individuals (hereinafter «Benefactors, «Visitors» «You» in any case) in the form of a charitable donation, including through public fundraising on the Foundation's website https://www.peremoga-ukraine.org/ (hereinafter «Site»).

1.2. When any individual visits the Site, the Foundation receives certain information about him/her. This Privacy Policy (hereinafter the «Policy») applies when an individual:

  • visits our site;
  • registers on our website to receive charitable assistance;
  • makes a charitable donation;
  • provides the Foundation with his/her personal data in another way for communication purposes.

1.3. This Policy defines the types of information and personal data that the Foundation receives from Visitors to the Foundation's website, the procedure for their collection, processing and use. Information and personal data are collected, processed and used in strict accordance with the requirements of the current legislation of Ukraine.

1.4. The Foundation reserves the right to make changes to the Policy at any time and for any reason, without additional notification to Visitors about the changes.

1.5.  Providing/posting information on the Site constitutes the Visitor's consent to the content of this Policy and means that the Visitor gives his/her permission for the Foundation to collect, use and disclose/distribute his/her personally identifiable information in accordance with this Policy.

If you do not agree to the terms of this Policy, DO NOT send any information to Us and immediately stop using the Site.

2. Types of information that the foundation can receive

2.1. The Foundation collects information related to the Visitor only if he/she voluntarily provided the relevant information or expressly agreed to its provision and/or use. Information collected by the Foundation includes:

  • Information that allows to establish the identity of the visitor: We can collect information that allows to establish your identity (under the text «Personal data»), in cases where you decide to interact with Us and provide relevant information by means of feedback or by filling out separate contact forms, or registration forms on the Site, or otherwise provide this information through the Site, including by sending requests, making charitable contributions through the Site, etc. Personal data includes, among other things, information about your name, telephone number, residential address, e-mail address, details of your documents, and other similar information.
  • Secondary (technical) data: when you visit the Site, certain data are automatically recorded on the Foundation's servers for system administration, as well as for statistical or backup purposes using a number of technologies, including, but not limited to, cookies, tags, IP tracking addresses/tracking URLs and other tools. The recorded information may contain the name of your Internet provider, in some cases — your IP address, data about the software version of your browser, about the operating system of the computer from which you visited the Site, the addresses of websites that you visit at the same time as our Site and, if applicable, your search parameters that brought you to the Site, date/time stamps, number of clicks, advertisements viewed, and the like. You can block or disable cookies on your computer, which will limit the collection of Secondary Data, which is carried out through the use of cookies, but in this case you will not be able to use certain functional properties of the Site and your user experience may suffer negative changes.
  • We may also use other tracking services (third-party programs), such as Google Analytics, to understand and investigate your use of our Site. Please be aware that Google Analytics collects information sent by your browser as part of a web page request, including cookies and your IP address. In this case, Google also receives this information, and its use is governed by the privacy policy of Google and/or the operator of the Google Analytics software; We are not a party to your relationship with third parties, such as Google Analytics operators, etc.
  • Payment information: We do not directly collect information about your payment methods, such as bank cards, etc. If you wish to make a charitable contribution through the Site, you will be redirected to the website of a third party — a payment operator, through which you can make such a payment, your payment data will not be provided to the Foundation, but to the operator of such a payment operator. Please note that your data will be processed by such third party in accordance with its privacy policy or other agreement concluded with you. We are not a party to your relationship with third parties, such as payment system operators, etc.
  • Personal data of children: We do not wish to collect information about visitors who are under the age of 18. If the child's parents or other legal guardians discover that the child has provided certain information to the Site and believe that such information should be destroyed, upon their request, We will take steps to delete such information.

 

3. Use of the information we receive

3.1. Your Personal Data and other information provided by you are used only for the purpose for which you provide them to Us.

3.2. We will use the information provided by you in order to support and organize feedback from you, to send you correspondence, messages, information, to maintain our databases, including the database of contacts, visitors, benefactors, etc., to carry out statistical, sociological and other studies, for the formation of contracts and other documents that are necessary for the registration of Our relations with you, the formation of reports provided for by current legislation, as well as for the prevention of violations of confidentiality, legal norms or terms of contracts.

3.3. We do not sell information to third parties.

3.4. Any information received from Visitors may be transferred to third parties only in cases provided for by the current legislation of Ukraine.

 

4. Data security

4.1. The Foundation undertakes to carefully store the information and data provided by you in a secure manner, and to take all precautions to protect the information from loss, misuse or unauthorized alteration. However, no method of transmitting information over the Internet or mobile communications, or any method of electronic storage, is 100% secure. Accordingly, despite Our efforts, We cannot guarantee or ensure the security of any information You transmit to Us through Our Site.

4.2. You confirm that you understand the risks described above, in particular, that the information provided by you may be lost or obtained by third parties, and that you personally and independently bear all risks associated with this.

 

5. Dissemination of information we receive to third parties

5.1. We may transfer the information you provide to third parties only to the extent objectively necessary to achieve the purpose described above, or to protect the security or integrity of our Site, to take preventive measures against prosecution or to facilitate legal proceedings or at the request of other state bodies; or in cases where, in Our opinion, it is necessary to provide such information to prevent physical harm or financial loss, or in connection with an investigation into suspected or actual illegal activity.

 

6. Your data processing requests

6.1. The Foundation acknowledges that you have the right to access your personal data and is guided by your requests, where necessary. You have the following rights:

  • You may request access, correction, update or deletion of your personal data collected while using the Site.
  • You can request additional information regarding the purposes of processing your personal data; types of personal data that are processed; places of primary collection of personal data; subjects to whom the Foundation provides access to personal data; and the period of storage of personal data by the Fund.
  • You can object to the processing of your personal data, request the Foundation to limit the processing of your personal data, or request the transfer of your personal data.
  • In cases where the Foundation collects and processes your personal data based on your informed consent, you may withdraw your consent at any time. However, the withdrawal of your consent will not affect the lawfulness of any processing of personal data carried out by the Foundation before your withdrawal of consent, nor will it affect the processing of your personal data that is carried out on the basis of other than informed consent legal grounds for processing personal data.
  • At your request and if it is technically possible and there are legal grounds for this, the Foundation will provide you with a copy of your personal data or transfer it directly to another manager (owner). You have the right to file a complaint about the collection and use of your personal data with a supervisory authority for the protection of personal data.
  • To make a request, send an email to the Foundation at dp.peremoga@gmail.com with «Personal Data Request» in the subject line and provide the Foundation with full details of your request, including your contact information and any other details you consider relevant. The request states:

1) surname, first name and patronymic, place of residence (place of stay) and details of the document certifying the individual submitting the request (for the individual applicant);

2) surname, first name and patronymic, as well as other information that allows identifying the individual in respect of whom the request is made;

3) information about the database of personal data in respect of which the request is submitted, or information about the owner or manager of personal data;

4) list of personal data requested;

5) the purpose and/or legal grounds for the request.

  • The Foundation will respond to a request for access within 30 days from the moment of receiving such a request regarding personal data stored by the Foundation, or if the Foundation is unable to provide such data within the specified period, the Fund will notify you of this and explain the reason for the delay.
  • You may also be entitled to other rights provided for by applicable legislation.

Identity Verification Requirement: The Foundation is required by law to verify that any request submitted was made by a person with a legal right to access the data. Therefore, before providing any information pursuant to a personal data subject's request for access to such data, the Foundation may ask you to provide additional information that can confirm your identity and legal authority.

7. Privacy issues

7.1 You have the right to report privacy-related complaints to a national data protection supervisory authority. In Ukraine, this is the Human Rights Commissioner of the Verkhovna Rada, who can be contacted via the e-mail address hotline@ombudsman.gov.ua.
